Built Different Streetwear

These Terms and Conditions (“Terms”) govern your access to and use of the Built Different Streetwear website, online store, content and related services, and any order you place with us.


In these Terms, “Built Different Streetwear”, “we”, “us” and “our” refer to the business trading as Built Different Streetwear. “You” and “your” refer to a website visitor, account holder or customer.


By accessing our website, creating an account or placing an order, you agree to these Terms. Our Privacy Policy, Shipping Policy, Exchange Policy and any additional terms displayed for a promotion or product also form part of your agreement with us.


These Terms operate alongside your rights under the Australian Consumer Law. Nothing in these Terms excludes, restricts or replaces any right, guarantee or remedy that cannot lawfully be excluded.


1. Eligibility


You must be at least 18 years old and legally able to enter into a contract, or use the website and place an order with the permission and supervision of a parent or legal guardian.


If you place an order for another person, you confirm that you have authority to provide their delivery details and agree to these Terms on their behalf where applicable.


2. Using our website


You may use our website only for lawful personal shopping, browsing and communication with us.


You must not:


● use the website for fraud, unlawful activity or unauthorised commercial purposes;


● interfere with the website, its security or another person’s use of it;


● introduce malware, harmful code, automated attacks or excessive traffic;


● scrape, copy or extract website content or customer information without written permission;


● impersonate another person or provide false, misleading or stolen information;


● attempt to gain unauthorised access to an account, system or payment method; or


● use our names, logos, photographs, designs or other intellectual property without permission.


We may take reasonable steps to restrict or suspend access where we reasonably believe these Terms have been breached, fraud or security risks exist, or action is needed to protect customers or the website. This will not affect rights or obligations relating to an accepted order unless permitted by law.


3. Accounts and customer information


You may be able to purchase as a guest or create an account. You are responsible for:


● providing complete and accurate information;


● keeping your login details confidential;


● activities carried out through your account; and


● notifying us promptly if you suspect unauthorised access.


We may ask you to verify your identity or order information where reasonably necessary for account security, fraud prevention, payment processing or customer support.


4. Product information


We aim to ensure product names, descriptions, specifications, fabric compositions, care instructions, photographs, colours, sizing information and availability are accurate and up to date.


Colours may appear differently depending on lighting, photography and screen settings. Size charts are guides, and reasonable manufacturing variations may occur. These statements do not excuse a product that is materially different from its description or otherwise fails to meet a consumer guarantee.


Product packaging, labels or minor design details may change where this does not materially reduce the product’s quality, function or value. We will not substitute a materially different product without your agreement.


5. Availability


Products are subject to availability. Adding an item to a cart does not reserve it. We may apply reasonable purchase limits where displayed or where needed to manage limited stock fairly.


If an item becomes unavailable after you order, we will contact you and offer an appropriate solution, such as an alternative product, store credit with your agreement or a refund to the original payment method. We will not require you to accept store credit where you are entitled to a refund.


6. Prices and charges


All prices are displayed in Australian dollars unless stated otherwise. Displayed prices include GST where applicable.


Before payment, checkout will show the total price for the selected products and any applicable delivery charge, discount and unavoidable fee. Optional extras will not be charged unless you select them.


We may change prices for future orders at any time. A price change will not affect an order we have already accepted, except where you agree to the change or the law permits it.


If a genuine pricing or listing error occurs, we will contact you before dispatch. You may confirm the order at the correct price or cancel it for a full refund. We will not charge an additional amount without your agreement.


7. Promotions and discount codes


Promotions and discount codes may have separate eligibility requirements, dates, exclusions and redemption limits displayed with the offer.


Unless the promotion states otherwise:


● only one discount code may be used per order;


● codes cannot be exchanged for cash;


● discounts do not apply to delivery charges or excluded products;


● codes must be entered before payment and cannot be applied retrospectively; and


● promotions are available while stock lasts.


We may decline or cancel the use of a promotion where there is a genuine error, misuse or breach of the published promotion terms. If this affects a paid order, we will contact you and offer the choice to proceed at the correct price or receive a refund.


8. Placing and accepting orders


Product listings are invitations to place an order. By submitting an order, you offer to purchase the selected products under these Terms.


An automated order confirmation means we have received your order; it does not necessarily mean the order has been accepted. We accept an order when we expressly confirm acceptance or dispatch the products, whichever occurs first.


Before acceptance, we may decline or cancel an order for a legitimate reason, including unavailable stock, payment failure, an obvious pricing error, suspected fraud, a security concern, breach of a reasonable purchase limit or a legal restriction. If payment has been taken, we will promptly refund the cancelled amount to the original payment method.


Once an order is accepted, cancellation or amendment may not be possible if processing or dispatch has begun. Contact Builtdifferentstreetwear@outlook.com as soon as possible and we will try to assist. Your rights under the Australian Consumer Law remain unaffected.


9. Payment


You must pay the total amount displayed at checkout using an accepted payment method. You confirm that you are authorised to use the selected payment method and that the payment information is accurate.


Payments may be processed by third-party payment providers under their own terms and privacy policies. We may use reasonable payment verification and fraud-prevention measures. We will not make you responsible for unauthorised charges caused by our breach of law, negligence or security failure.


If payment is reversed, declined or charged back without a valid basis after products have been supplied, we may contact you to resolve the amount owing and exercise rights available under law.


10. Shipping and delivery


Australian shipping options, processing estimates, tracking, local pickup, delivery issues and returned parcels are explained in our Shipping Policy.


Delivery estimates are not guaranteed unless expressly stated. We will provide accurate information available to us, notify you of significant known delays and provide an appropriate solution if an order cannot be supplied within the promised time or a reasonable time.


Risk in a product passes to you when it is delivered to the address you provided or collected by you or your authorised representative, subject to applicable law.


11. Pre-orders and made-to-order products


Pre-order, back-order and made-to-order products may have different processing and dispatch estimates, which will be displayed on the product page or order confirmation.


Estimated release or dispatch dates may change for reasons outside our reasonable control. If there is a significant delay, we will provide an update and options required by law. We will not retain payment indefinitely where we cannot supply the product within the promised time or a reasonable time.


12. Exchanges, returns and refunds


Our Exchange Policy explains our voluntary 14-day change-of-mind and sizing exchange process, eligibility conditions, exclusions and postage arrangements.


Change-of-mind exchanges are separate from your rights where a product is faulty, unsafe, incorrectly described, not fit for a disclosed purpose or otherwise fails to meet a consumer guarantee.


We may request reasonable proof of purchase and an opportunity to assess a product before providing a remedy.


Under the Australian Consumer Law:


● if a product has a major problem, you may be entitled to choose a refund or replacement; and


● if a product has a minor problem, we may choose to provide a repair, replacement or another remedy within a reasonable time.


Consumer guarantee rights are not limited to a fixed number of days and may apply to sale, clearance and final-sale products. Our policies do not remove these rights.


13. Care and use of products


Please review sizing, fabric and care information before purchase and follow the care instructions supplied with each garment.


Damage caused by misuse, accidental damage, ordinary wear and tear, improper washing or drying, alterations, or failure to follow clear care instructions may not constitute a product fault. This does not affect any rights that apply where the product itself was not of acceptable quality or the instructions were inadequate.


14. Intellectual property


The website and its contents—including the Built Different Streetwear name, logos, monograms, garment graphics, artwork, photographs, videos, product descriptions, layout and other original material—are owned by or licensed to us and are protected by applicable intellectual property laws.


We grant you a limited, revocable, non-exclusive and non-transferable right to access the website for personal, non-commercial use. This does not transfer ownership of any intellectual property.


You must not reproduce, modify, distribute, sell, license, manufacture from, create derivative works from or commercially exploit our content or designs without prior written permission, except where permitted by law.


15. Reviews and customer content


If you submit a review, photograph, video, comment or other content directly to us for publication, you retain ownership of your original content. You grant us a non-exclusive, worldwide, royalty-free licence to store, reproduce, display and adapt that content for the purpose for which it was submitted, including promotion of Built Different Streetwear, unless we agree otherwise.


You confirm that you have the rights and permissions needed to submit the content and that it is not unlawful, misleading, defamatory, infringing, abusive or harmful.


We may moderate or remove customer content for a legitimate reason, including a legal, safety, privacy or platform-policy concern. We will not alter or suppress genuine reviews in a misleading way.


16. Third-party services and links


Our website may use or link to third-party services such as ecommerce platforms, payment providers, social networks, analytics services and delivery carriers.


Third-party services may have their own terms and privacy policies. A link does not mean we endorse or control the third party. We remain responsible for obligations that Australian law places on us as the seller and will not require you to deal solely with a third party where we are legally responsible for resolving an issue.


17. Privacy and marketing


Our Privacy Policy explains how we collect, hold, use and disclose personal information, including information used for orders, customer service, analytics, fraud prevention and marketing.


Where you consent to marketing, you can unsubscribe using the instructions in the message or by emailing Builtdifferentstreetwear@outlook.com. Unsubscribing from marketing will not stop necessary order, account or customer-service communications.


18. Website availability and information


We take reasonable steps to keep the website secure, available and accurate. The website may occasionally be unavailable because of maintenance, updates, faults, third-party outages or circumstances outside our reasonable control.


We may correct website errors and update content. Changes will not remove rights relating to an existing accepted order or a representation on which you reasonably relied, except where permitted by law.


General website content is provided for shopping and informational purposes and is not professional advice.


19. Liability


Nothing in these Terms excludes, restricts or modifies:


● the consumer guarantees or remedies under the Australian Consumer Law;


● liability that cannot lawfully be excluded or limited; or


● liability for fraud, wilful misconduct or personal injury caused by negligence where exclusion is prohibited.


To the extent permitted by law, we are not responsible for loss or damage that:


● was not caused by our breach, negligence or unlawful conduct;


● was not reasonably foreseeable when the agreement was made;


● was caused by your misuse of a product, breach of these Terms or failure to follow reasonable care instructions; or


● resulted from an independent third party or event outside our reasonable control where we took reasonable precautions and fulfilled our legal obligations.


We remain responsible for remedies and reasonably foreseeable loss where required by the Australian Consumer Law.


20. Events outside reasonable control


We are not responsible for delay caused by events outside our reasonable control where we could not reasonably prevent the delay. Examples may include severe weather, natural disasters, carrier network disruption, power or internet failure, industrial action, government restrictions or widespread supply-chain disruption.


We will take reasonable steps to reduce the effect of the event, communicate significant delays and resume performance when practical. This section does not remove any right you have to a solution where products cannot be supplied on time or within a reasonable time.


21. Complaints and disputes


If you have a concern, please contact Builtdifferentstreetwear@outlook.com with your name, order number, relevant details and the outcome you are seeking. We will review the matter and try to resolve it fairly within a reasonable time.


Nothing in these Terms prevents you from contacting a consumer-protection agency, lodging a payment dispute where legally available or exercising any other legal right.


22. Changes to these Terms


We may update these Terms to reflect changes to our website, products, business practices or legal obligations. The updated version will be posted with a new effective date.


Changes apply prospectively and will not unfairly alter an order already accepted. The Terms in effect when an order was accepted will generally apply to that order unless the law requires otherwise or you agree to a change.


23. General terms


If a provision of these Terms is unlawful or unenforceable, it will be read down to the extent necessary or severed, and the remaining provisions will continue to operate.


If we do not immediately enforce a right, that does not waive the right.


You may not transfer your contractual rights or obligations without our consent, except where the law permits. We may transfer our rights and obligations as part of a genuine business sale or restructure, provided this does not reduce your rights and you are notified where required.


These Terms, the policies incorporated into them and any accepted order confirmation form the agreement between you and us regarding your use of the website and purchase. They do not exclude any representation or right that cannot lawfully be excluded.


24. Governing law


These Terms are governed by the laws of South Australia and applicable laws of the Commonwealth of Australia.


The courts of South Australia and relevant federal courts have non-exclusive jurisdiction. If you live elsewhere, this does not prevent you from relying on mandatory rights or protections available in your location.
